This End-User License Agreement (“Agreement”) is a legally binding contract between you (“User,” “you”) and Drag & Drums (“we,” “us,” or “our”) governing your use of our digital products (“Products”).

By purchasing, downloading, accessing, or using any Product from www.draganddrums.com, you agree to be bound by this Agreement.

​

If you do not agree to these terms, do not purchase, download, or use the Product.​

 

1. Grant of License

​

Upon purchase, Drag & Drums grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Product in accordance with the terms of this Agreement.

​

This license does not transfer ownership. All rights not expressly granted are reserved by Drag & Drums.​

 

2. Permitted Musical Use

​

Notwithstanding the restrictions set forth in this Agreement, you are expressly permitted to use the Product as part of original musical compositions, recordings, or audio-visual works.

​

You may:

​

• Incorporate the Product into your own original songs, beats, or productions

• Distribute, perform, stream, broadcast, and monetize those compositions commercially

• Use the Product in released music, films, videos, games, or other media

​

Provided that:

​

• The Product is embedded within a larger creative work

• The Product is not distributed, licensed, or made available in isolation

• The Product is not extractable or usable on its own by third parties

​

This permission applies only to finished creative works and does not grant any rights to the Product itself.

​​

3. Prohibited Uses

​

Except as expressly permitted under Section 2, you may not, under any circumstances:

​

• Copy, duplicate, reproduce, or redistribute the Product

• Sell, resell, rent, lease, lend, sublicense, or otherwise commercially exploit the Product itself

• Share the Product with any third party

• Upload the Product to any website, cloud storage service, forum, torrent, or file-sharing platform

• Use the Product in any competing product, sample pack, sound library, or similar offering

• Remove or alter any copyright, watermark, or ownership notice

Any unauthorized use constitutes a material breach of this Agreement.

​​

4. Commercial Use Restrictions

​

Purchase of the Product does not grant a commercial license to redistribute or resell the Product itself.

​

Commercial use is strictly prohibited where it involves:

​

• Redistribution of the Product or derivative files

• Inclusion of the Product in any product or service offered for sale as audio content

​

Any commercial rights beyond those expressly granted in Section 2 require prior written permission from Drag & Drums.​

 

5. Intellectual Property Rights

​

All Products, including audio files, content, branding, and documentation, are the exclusive intellectual property of Drag & Drums and are protected by copyright and applicable intellectual property laws.

​

This Agreement does not grant you any ownership rights in the Product.

​​

6. Enforcement & Termination

​

This license is effective until terminated.

​

Drag & Drums reserves the right to immediately terminate this license without notice if you breach any term of this Agreement. Upon termination, you must cease all use of the Product and delete all copies in your possession.

7. No Refunds

​

All Products are digital goods. As stated in our Terms & Conditions, all sales are final, and no refunds are provided once delivery has occurred.​

 

8. Disclaimer of Warranties

​

The Product is provided “as is” and “as available,” without warranties of any kind, express or implied, except where prohibited by law.

​

We do not warrant that the Product will meet your specific requirements or be error-free.

​​

9. Limitation of Liability

​

To the maximum extent permitted by law, Drag & Drums shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use or inability to use the Product.

​

Our total liability shall not exceed the amount paid for the Product.​

 

10. Governing Law

​

This Agreement shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles.

​

Consumers may have mandatory rights under local consumer protection laws that cannot be waived.​

 

11. Severability

​

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
